State of Ohio Judgment Liens
by Ted Mullucey | 2012/02/09 |

I'm looking for clarification on the statue of limitations for certificate of judgments filed in favor of the State of Ohio. There's conflicting opinions that they are good forever or  they are only good for 15 years. Any input would be appreciated.

Ah, yes... the joy of state tax liens!

Hey Ted,

I don't have time to write a long answer.  It is after midnight and I have to get up at 6:30 for an out of town deposition tomorrow.  But, I did write a blog about this a few years back that might shed some light on it.

See Ten, Infinity, Twelve, Fifteen... and Twenty-five

I wish I had thought to include a link to the statute, but I didn't.  When I get some more time, I'll try to dig that up again, for further reference.

Best,
Robert A. Franco

State of Ohio CJ's
From a chart supplied to me by an Attorney whos is a VP for a large title company in the Central Ohio area that list various liens filed in Ohio as of 2011, CJ's in favor of the State of Ohio are good for 15 years per O.R.C. 2329.02 & 15 years for State of OHio, BWC liens under O.R.C. 4123.76.
