Was it not just a few years ago that they settled another class action suit alleging the same?  Unless the penalties start to be harsh enough to actually get them to stop this abusive practice they will continue on. 

With the huge market share that they have a slap on the wrist is worth it to them to continue in the same manner and to take their chances of getting caught.
