Michigan Court: MERS Seeking Rights Without Assuming Responsibilities

In a 2-1 split ruling, a Michigan appeals court ruled last week that MERS cannot foreclose on a homeowner using the state's non-judicial foreclosure process-- adding to a growing list of states where courts have ruled that MERS may not foreclose in its own name on a MERS mortgage.
