I have a transaction on my desk for a property located in Baltimore City which was sold at auction to an investor. The title report reveals that title is vested by recorded Deed in an individual, but the contract of sale is between the investor and ABC, INC. Receiver. I could not for the life of me figure out how this "Receiver" came into the picture.
Further review of the file, in partiular the judgment reports, reveals a District Court case titled "Petiton for Appointment of a Receiver" This case was filed by the Mayor and City Council and is a Petiton for a Vacant Building Receiver" . As it turns out the City has utilized it's powers to "take" this property from the homeowner, put it into the hands of a "Receiver" which receiver is then tasked with selling to an investor for rehab or to qualified buyer.
My understanding of the transaction is that the record owner will be divested of her interest upon court Order approving the transaction; any liens, including mortgages of record will be wiped out and the property will convey free and clear to the new buyer.
This is the first time I have ever come across this partiular type case and just wanted to remind those doing work in Baltimore City that you MUST check those District Court cases as well as the Circuit Court cases.
