This is in reference to copies.
Companies are trying to force us into suppling our business's receipts from court houses for copies etc..
When an order is received it is being ordered
from us an abstracting company and an invoice/receipt from us is supplied for
the order. This would also include any additional add-ons for the order such as
copies, addresses of lien holders, estate info etc...
The invoice/receipt for any items ordered
comes from the entity you ordered it from, in this case the abstracting
company.
If you require an invoice/receipt from
another entity then you need to order from them.
As far as the new laws put in place for
closings the copy requirement is to list a separate line item for copies from
the search fee to show the end buyer what the fees are, so closing companies
can show all costs. We always provide an invoice with that break down. It is
not possible for the law to require a company to get an invoice/receipt from a
entity they do not do business with.
Whom you order work from is whom you will
receive a invoice/receipt from.
Now;
We will always try and get you everything you
order and need to complete an order with out any issues we do not mind
following up on any questions etc...
However requesting (forcing) us to turn over
our receipts from our business practices is wrong. It would be like me walking
into my local grocery store and telling them I need to see their receipts from their
purchases of the items I am going to purchase from them. And then haggling with
them on what I should pay, telling them they can provide a service of getting
the item and making it available to me but are not allowed to make any profit,
they need to do it at their cost. How long do you think they would stay in
business or even start one if that was the way it worked?
Retrieving copies in the areas we cover can
be time consuming and money draining task. Any time an order requires more then
the current deed copy at minimum triples the time involved never mind the money
that has to be put out.
We have any where from 3 to 6 separate offices
in each county to retrieve various copies from each having their own ways and
fees.
Some copies are on the computer, but they are
usually printed on an account that we put money on in advance for all copies
needed for all orders. Copies print to one printer for everyone in that office.
Therefore we have to go through all copies printed and make sure we get all our
copies and not someone else's and no one else takes ours. Some offices the
printer is behind the counter and we have to wait for them to go through them
and separate them and hope we get them all.
Some we have to use a copier (some counties
only have one for everyone) that is one page at a time that requires quarters
and no receipt comes out a very timely task. This could be large books which
you can't take a part or file folders.
Some are on microfilm or cards another
daunting time consuming task. Paying for these vary, pay at a counter, put
money in a tin cup or use your prepaid account.
And some of the offices you have to take a
part books and your only allowed to do one at a time and wait for them to make
the copy which can take a long time if their busy and then put book back
together and get out the next one.
Some offices you pay for all your copies when
you pick them up. No separate receipts. They would not like us for very long if
we started asking for a bunch of separate receipts and we need to maintain a
good relationship with these offices. And if this was truly a requirement they
would have to hire someone just to do receipts and copies for us.
And retrieving maps, assessment cards, GIS
maps etc... is another lengthy time consuming task. And usually a lot more
expensive.
Some counties charge $5.00 per docket some
charge anywhere from $2.00 to 20.00 for a map.
Then after all this we have to take them back
to office organize them, scan them making sure all copies are readable and
there especially when only certain pages are requested instead of a whole
document.
Abstractors/searchers put out a lot of money
for copies and do not see it for 30 to 120 days depending on the company paying
for them.
