Removing Illegal Restrictive Covenants from Recorded Documents
Discriminatory deed restrictions have been illegal for several decades, but they still remain in the public records. There have been efforts, both through legislation and through the courts, to modify or remove them. There is no doubt that they are unenforceable, but can they be stricken from the recorded documents? In some states, the answer may be yes.
