I posted a blog about Ohio's latest proposal to abolish dower. If dower is abolished, a non-title holding spouse will be at risk of having the family home mortgaged or sold without their knowledge or consent.  Not surprisingly, divorce lawyers are opposed to the change that is mainly being pushed by the Ohio Land Title Association.  Do other states, without dower, have any protections for non-title holding spouses?

What protects a spouse who is not on the deed from having the title-holding spouse cash-out all of the equity in the house and blowing it on drugs or gambling just before filing for a divorce?
