Dave- Be sure to be relentless with detailing all the facts to the title insurance company and the the E&O carrier- they tend to drag their heels or just plain "ignore" you when they think or know they will have to fork out money. The only case I have been involved with had the E & O carrier stall for over 15 months before any real action- and by then all the damage had been done- the title insurance company had paid on a threat and as it eventually turned out , it was a fraudulent conveyance and they got away with it- got the insurance money, got foreclosed on- family member purchased the property back and then within a year sold it back to the original owner - all because the insurance company did "no" investigation , just cut a check- I bet their stockholders are proud of them in this!!
