You're correct, more than likely it is worthless. However, when it's the only thing found of record, whether it's filed by a homeowner or an attorney and no one else can be contacted we provide that information to our client and let them handle it in the way they see fit. We treat the mortgage as if it is still open, and include it in the report as such. We have noticed fillings afterward on the properties by different attorneys, who have appeared to have solved the issue before closing. We just report what is found on the record and do not give an opinion of title.
