The length of the statute of limitations is state specific. In some states it begins to run at the time the error is made. In other states it begins to run from the time the error is discovered. There are also circumstances which can lengthen the statute of limitations (e.g. absence of the defendant from the forum state). Many states have their statutes on line, and you can do a search to determine the length of the statute of limitations in your state. It would be best to consult an attorney to avoid any confusion or your misinterpretation of the statute.
