Hi, Patrick: It's a great topic for a round table. All of the abstractors I use say they have trouble with some attorneys and title companies who expect the abstractor to forgive the fee if the deal doesn't close. Maybe it's just our area, but I see this as an issue. What I'm really asking the abstractor community to do is talk about what you do with Realtors and mortgage lenders out on the web. The more they understand how much work you do and how you are paid, the more likely they will be to at least tell the consumer they owe someone money when the deal cancels.
When we started billing for cancelled titles, the lenders and agents we work with were somewhat perturbed but the good ones understood once we explained the system. They even tell the customers before we do to expect an invoice.
I just got off the phone with a buyer whose sale is falling through because the land didn't perk. He has already paid us a $300 deposit and wanted to know if he owed anything else. That seems amazing but most people aren't cads. If they understand the reality, they'll work with you.
