I agree that the abstracting fee should be considered the same as an appariser's fee, and, as such, should also be listed on the HUD-1 payable to the abstractor as it is listed payable to the appraiser. After reading Jarrod's article on the new UCI, I believe that abstracting fees, as well as all the other items, should be listed specifically on the HUD-1. This, however, many be a problem for states where the abstracting fee is included in the title insurance premium (such as New York).
Although there are many companies out there who try and stiff the abstractors, I personally have not seen it where it was due to the closing being cancelled or rescinded. It is the VM or title agents who order the search, close the file, collect the fees and conveniently forget to remit to the abstractor.
Although I am not able to attend the conference in New Orleans, perhaps this concept should be included in the round table discussion.
