Even title agents in states like PA where we have all-inclusive premiums can collect a deposit up front or invoice for title cancellation if the transaction does not close. In fact, in PA the TIRBOP rule REQUIRE that a title commitment cancellation fee be charged in a minimum of $100. Title agents are terrified to do it and I think that's ludicrous. Our PAR sales agreement even includes language in TWO places in which the buyer agrees to pay for the title search if the deal falls thru. WHY are people conveniently ignoring what is so obviously the right thing to do?
