If you do title work, just check the dedication of the subdivision, any HOA that is created will usually be a party to these documents, and then the common area (that is to be held by the HOA) will usually be conveyed right after the recording of the dedication. Of course this is not a hard rule, the developer can do a good job of messing this simple act up too.
