In the case of Connecticut attorneys it is even easier to collect from non-paying individuals because we have an inchoate common law lien on the file and all proceeds received by the individual which he received as a result of the attorney's work. The lien travels with the file, and all who come into possession of the file and receive funds from the attorney's work are subject to the lien. This could include a signing service, title company and lender...any or all of the above. When necessary to enforce the lien, I generally explain that I plan to garnish the mortgagor's monthly mortgage payment to the lender to satisfy the lien. Generally one of these parties will understand the gravity of the lien, and pay the attorney's fees before actual enforcement becomes necessary.
