I am sure that I am probably far off base here but I thought I would throw in my 2 cents worth on this...of course this is just a possible scenario but figure I would throw it out there anyway. Recently (within the past yr) my dad went into a nursing home and the house that was owned as TBE between my parents had to immediately be switched into my mother's name. Now in this instance with them both being elderly I hold POA for both my parents so I signed as AIF for my father but if my mother had had POA she would have signed it over herself . It *might* just be that medicaid/medicare dictated that the title be in the name of the spouse not located in a home (assuming that is the case), in NJ with the home in both names it affects the monetary value of aid and getting the house into the name solely of the one spouse alleviates this issue. As I said just my two cents worth, not a lawyer and don't want to play one on tv but as I read your original post Scott, that was the first scenario that came to my mind.
