I can give you Connecticut's position on this matter, but you would need to see if the subject state's position is the same. The sovereign immunity doctrine does not protect political subdivisions such as counties, cities and towns. As such the municipal government would be liable for damages resulting from a wrongful destruction of the residence in question.
