That would be one argument that could be made...it may also depend on the type of survey that was ordered. As I understand it there are different levels of surveys...some are more complete than others.

The neighbor would file a claim against the homeowner. The homeowner would join the surveyor to the suit as either a co-defendant or third party defendant.
