I filed a civil summons against Capstone through the county magistrates office, where I live here in WV.   It doesn't matter  if the company is out of state or not.  The magistrate will file a civil summons, which in WV they have 20 days to respond to.  After that,  I had to go back and file a default judgement.  Again, they will have roughly 20 days to respond.  The last step was the county sheriff executing a writ against their banking institution, which will garnish the wages owed and their bank will issue a check for your claim, including the costs of the judgments, which costs me $140.  I have all the information you will need (company address, bank , etc.).  Please email me and I will be happy to share that info with you.  Best of luck!
