Robert, I agree, that is only fair. I think the frustrating thing is having to spend your limited time to resolve a problem that was not your fault nor your liability and basically having to argue with your client about payment for the extra work. It also brings up a question of the difference in liability between the abstractor and the title company. Even though you were only requested to perform a current owner search, the title company who issued the last policy seems to be "on the hook" for anything title issues that happened prior to the current owner. Am I correct here? This is something I just don't quite understand.
