Always interesting to read about these - people just don't understand their property rights. Unfortunately, here, it appears that Graham and Dampier were able to find an equally ignorant attorney. In my experience as a real estate attorney, I have spoken with a few clients regarding property disputes. However, I advise most of them of the rights they have, or don't, and even where the propery owner may have a valid legal claim, most are not interested in paying the legal fees required to enforce them. Most of the time, it is best to make nice with the neighbors and learn to get along, anyway.
But, I'd love to have clients like the Bergs... a good claim and willing to pay legal fees. ;-)
