Jolene,

Although I agree with you about the fraud on the seller's part, I think it's really a separate issue from the question posed, which is:  "Who is the legal owner of the real estate?"

Each state has recording laws that address this type of question.  And, no doubt, they all have mountains of court cases that would shed light on which bona fide purchaser would be recognized as the owner of the land.  In this case, both Andy and Bruce are bona fide purchasers, because nether had notice of the sale to the other (at least in Illinois, where notice is a part of the equation). 

Incidentally, Minnesota is also a race-notice state.  From The Boundary Line dot com:

 "Minn. Stat. 507.34 states that “every such conveyance not so recorded shall be void as against any subsequent purchaser in good faith and for a valuable consideration of the same real estate, or any part thereof, whose conveyance is first duly recorded” and Minn. Stat. 507.32 states that “any instrument properly recorded shall be taken and deemed notice to parties."
