I wish I did not have to carry E&O insurance but several clients cannot give me work if I don't have it. And of course I feel more comfortable with it than without. I will admit that during my 35 year career I only had it for about 4 years (many years ago) and now have had it for the last 3 years. I've never had a claim and no one has threatened to sue me. But years ago I personally know most of my clients. Now many are a thousand miles away and I've never even spoken to them on the phone.
Seems like the title companies should insure independent title searchers but I know that won't happen so I feel like I have no choice. Can't afford to lose any clients.
I have, for many years, put an exception on every search report limiting my liability to the amount of the search fee. I know it's probably meaningless but, what the heck.
To update my original post: My agent sent me the renewal a couple days before the renewal date so I felt like I had to renew at the new price. They got me this time but they'll find next year that they have lost a customer. Actually they'll find out sooner if I can figure a way to cancel and change without losing too much $$.
