Laurie, make sure you were actually paid for the search. No pay, no liability.
Also, check the indexing laws in the state in which the search was performed. In TN, you rely on name indexes most of the time (might be different if you were using someone's plant instead of going to the courthouse). But across the state line in Miss, the law states that the tract book prevails over the name index for certain types of land (mostly residential subdivisions since 1993 or 1994). Might be the difference that makes the difference.
As for legal counsel, it never hurts to have someone in your corner that you have a relationship with. You probably have a client you can get some advice from. Trade 'em a title search or two. :)
