I have been in business for just over 7 years and it finally happened..I received a package via Fed X today with a letter from an attorney that we missed a mortgage on a search we did in early 2006 and that we should notify our E & O insurance company and send them a confirmation. 

The mortgage for which  we did the search is now is Lis Pendens and the Mortgagee to the mortgage we missed is claiming a superior position.  Well as you can imagine, I double checked our work and  found that in fact,  we did miss the mortgage, because the official records dept had it indexed with  another legal description since it was a Cross Collateriled mortgage on two properties, including ours.... The names searched owned several propeties at the time and so we only looked at the documents with our legal. ...

Since this is the first claim against us, I would appreciate any insight or advice.  Thank you in advance!
