I discussed this case with Gary Daves, who is a Columbia, SC real estate attorney. He states that he believes we should check the judgment files to see if any activity occurred within the 10 years or two years subsequent to the judgment being rendered.
In the case at hand, there was a Confession of Judgment, which casts a different perspective on the matter. The judgment debtor made payments on the judgment in the ensuing 10 years, and then the judgment creditor would not allow them to make the last payment because it was a few days late.
