it is certainly a matter of systemic, ongoing, regular and frequent incompetence by the foreclosure mills who are, AGAIN, not actually checking these papers prior to Official filing.

Except you have no evicence of systemically flawed process.  You only have evidence of a flawed outcome.  Could simply be human error-- they put the paper in the wrong pile or something.  I'm not suggesting that this should not be investigated, mind you, but rather that it is incorrect to presume that the cause of any error is the result of systemically flawed process.

With the robo-signers, we have seen evidence that the flawed process was widespread and institutional in nature.  We have sworn depositions that describe the flawed process.  We have testimony that the robosigners were acting in accordance with the policies set forth by their superiors-- the employees were actually "competent" in doing their job as defined by the company.  In your case, it could simply be that one or two employees simply is incompetent and not doing their job very well.  Maybe their superiors get mad when they file notices in the wrong county.

If a homeowner is damaged because of a misfiled foreclsoure notice, then perhaps the victim's lawyer can depose the employee whose mistake caused them damage, as has been done effectively in several other cases?  Ultimately, the person with the greatest motive to dig deeper into some purported abuse should be the victim of the abuse, right?
