Am I right in thinking that perhaps Chicago Title shouldn't be providing "yes/no" answers to title inquiries in the first place?  I agree with the verdict - he should have purchased title insurance, but it seems like providing hurried "yes/no" emails to something that could cost your client quite a large sum of money isn't very business savvy... at least from my point of view.
