Robert: The use of marginal entries was a great help in years past. However, today its been sadly reduced to a notation in the "remarks" section only. My question is : can the recorder "legally " force someone to pay for a marginal entry on a mortgage subordination if the person filing does not want the marginal entry. In addition some recorders are apparantly also requiring you to pay an additional $4.00 to "marginalize" the "new " mortgage (as well as $4.00 to marginalize the old mortgage). I'm not against paying for a marginal entry as long as I have the option and legal right to say no. ( I also believe that there are certain documents that do require mandatory marginals but thought that mortgage subordinations were not in that catagory). What do you think? Thanks, Edward.
