I believe that anytime a new document refers to another document, a marginal notation is required. I don't think you have the option to say "no." I guess the notation in the remarks section is the modern day equivalent of the marginal notation. But, I believe that there are some counties who still charge the fee and don't even do that. In my opinion, they can't do that but it happens.
I think this is another example of how the law hasn't kept up with modern technology.
I'm still not sure why you wouldn't want the notation, even in the remarks section. I don't think anyone should have the right to refuse the marginal notation. It is one of those things that is for the benefit of everyone searching the records who come along later.
