Well... if I were a barrister circa 1700, I would ask the ship's owner for a list of crewmen. Then I would check the local pubs and see if they were still drinking ale. Next, I would depose all of the people who supplied the ships with provisions. I would imagine that the ships would be in port for sometime before it sailed and the locals probably all knew who was on what ship. It might be difficult to prove... but if you can prove it, there would be no coverage.
