Does the local County Recorder have the authority to insist on charging for a marginal entry? For Instance when you file a Subordination of Mortgage some Recorder's will collect $4.00 for one marginal entry (if you want this), some REQUIRE you pay the $4.00, and some Recorder's REQUIRE that you pay $8.00 (one marginal for the old mtg. and one marginal for the new? mtg.). Is this charge a local option granted by the State of Ohio under the ORC ? Can this be challanged?
