Kevin, that would most certainly suck and sounds like a claim on the Owner's Policy.  I have seen many examples of similar situations - all claims paid by the underwriter. Not sure how that would slip thru the cracks of an exam.  We use mortgage location surveys here and there are several that do not notate all the easements.  I would think I search would have caught it first before the survey was ever done.
