yes, I am the buyer, I couldn't go throught another mortgage with this lender if I life depended on it.  I do not see why the funds could not be used as they were intended to be used for the expenses of the loan , which they would be without a doubt. As long as the intent is satisfied on both sides, it should be allowed.
