The issue of title insurance rates and the split retained by the title agent are in the spotlight right now in PA.  That's why the Attorney General requested a public hearing.  Much will be discussed including steering, rebates, and cancellations fees.

The indirect benefit real estate agents and mortgage lenders get from the lack of charge for the production of a title insurance commitment is sitll an unlawful rebate.  If title agents were charging as they are required to do, real estate agents and lenders would have to be careful about pre-qualifying and they'd have to make certain their consumer understands the risk.  Frankly, when we talk directly to consumers they almost always opt into our Choose and Save program and put up the $300 non-refundable deposit.  It's all about what you say and how you say it.  Just because something has always been done this way doesn't mean it is right.

In the Pittsburgh metro market it costs about $350 out of pocket to get municipal lien letters and a full search.  Who cares if the consumer has to pay or the real estate agent or lender?  Why should it be us?
