It may be too late now, but I was always leery about  holding funds that were the subject of dispute.  You could try to convince them to have their attorney (or the attorney who drafted the trust) hold the funds until they can agree.  That way, you eliminate the possibility that you would have to petition the court to get those funds disbursed properly.
