As a abstractor, I think Wayne has done what can be expected. Given that he tried to contact the abstractor AND sent a fax advising that he either didn't have the correct numbers or that their numbers were not working, I'd say he fulfilled his obligation. There is a fine line on the communication issue. Sometimes, there is too little, sometimes there is way too much. Sometimes, if the client would quit calling and asking "status" we MIGHT actually get the search done. The times that really irritate me are when a company faxes, they beg a rush, you agree to run right out and do it and THEN they fax a cancellation---they HAVE to know you aren't there to receive it, you are where? that's right, at the courthouse doing their rush. That is why most abstractors have cell phones. But I believe it is my responsibility to make sure that my clients have the appropriate numbers. Expecting Wayne to only fax and not have any other contact number is like handing out business cards with just your name on it. Given the fact that the abstractor didn't call Wayne, especially when he sent the cancellation makes me think they don't have a working phone, just the fax.
