Unfortunately, it isn't just illegals that cause these kinds of problems.  There are many Americans who have the same attitude and do not maintain insurance.  I had an employee once that was in a similar accident and though it was obviously the other person's fault, she kept blaming my employee.  The officer refused to write a ticket because "he didn't see the accident."  In my opinion, this is just lazy work by the police who don't want to have to do more paperwork.
