Do anyone know what is the abstractors obligation when given the wrong taxes by a municipality. Hers in Jersey we must call the Municipality and get a verbal on the status of property taxes. I did this and wrote down exactly what was said. Now four months later I get a call from my client stating that the taxes was wrong and the borrower owes the last two quarters of last year and the first quarter of this year and that I must send them a check for the total. Two questions comes to mind 1) am I accountable for the first quarter of this year that was not in the time period of my search ( the index date was 11/26/06) and 2) am I accountable for the mis given info I received from the Township being I can not physically search for taxes. Any advise will be appreciated, this $50.00 order is turning into a $6,000 monster. If I do have to pay this whole amount what can I do to protect myself in the future? Being I can not search for taxes myself.
