I can't say for sure if they are enforceable here in NJ but I do know that most if not all the abstractors here use a disclaimer, I know that personally I do and I feel better with it there myself. I am not negligent nor naive so I know that disclaimer or not it won't keep me out of a lawsuit but if it can help in a lawsuit then why not. Plus if you look at any of the policies here the title companies and underwriters make sure that THEY have a disclaimer regarding things that could effect that aren't included...if they are the ones who are actually insuring it and they have a disclaimer then why wouldn't it be in my best business interest to have one also? I've discovered that after almost 20 years in the business no matter how good you are or how bad you could be that the theory of "CYA" (cover your a**) is certainly necessary; especially in today's market. Of course this is just my 2 cents worth early on a Sunday morning straight out of  bed.
