There is a solution and it is being approached by many state and federal legislators now. Our legislators are finally coming to realize the damages suffered by the people when our sensitive and personal information is broadcast over the Internet. Class action litigators are also picking up on this simple concept and filing suits all over the country against state and local governments who have violated their jurisdictional authority.

No government entity has the authority to act outside it's own jurisdiction. When a county government publishes county records online they are acting outside the bounds of their jurisdiction and without the authority granted them by their citizens. When a county, state or federal agency, sells or transfer the documents in bulk over the Internet or by any other means, they sell an asset created by the people and given to them for preservation and access within the jurisdiction. 

This jurisdictional approach denies access to no one. It protects the citizens of the jurisdiction by limiting access to them. It codifies thousands of years of common law perception of "public" and "access" and returns the American identity to the American people.

Their are several class actions being filed across the country that may take this approach to local governments and their technology company partners exceeding their authority by releasing private and confidential information outside the jurisdiction. I expect there may be many more if government doesn't act to protect the people and reign in the counties who exceed their jursidiction.

Just some thoughts.
