I agree. I was thinking about the very same things last night. With all the claims on title that we have seen in the last 20 years, this is opening the door for a host of problems and court proceedings that will just inundate the legal system. With the lack of staffing at clerk's offices due to upside down funding and furlows, we see huge issues now with the quality of recording in counties now. Unless we are physically reviewing these actual records, where is the knowledge to understand the existence of technical issues, such as 3 years of a clerk of courts' computerized system throwing certain mortgages out there as satisfactions or protected non-viewable status? Certain nuances in certain counties are just known. Just like knowing certain subdivisions have 3 homeowner associations that they are a part of, or which cities were annexed partially into another county that they border and when.
