We had one client that expected us to "waive" our fee if the order didn't close.  We didn't realize that their expectation until we tried to collect on about one-third of their bill that wasn't paid.  We eventually got paid and told them to find another abstractor.

Granted, if the file doesn't close, they don't get paid, but when they do close they make around $1,000 (compared to our $45).  If we should be expected to "waive" our fees if orders do not close we should be getting compensated more for the others to make it an equitable arrangement.

My position is, if you order it, you pay for it.  They got the search they ordered, whether or not the file closes, they pay for the service.

Best,
Robert A. Franco
