The defense to which you make reference is called contributory negligence. At one time it was a complete bar to the plaintiff's recovery. However, most if not all states are now comparative negligence states. This means that if the defense of contributory negligence is raised, the trier of fact would assign a percentage of dollar value to the negligence of the plaintiff, and then deduct that from the amount of damages awarded to the plaintiff.
