well...obviously, your reading of the complaint was not a careful one. Unless I misunderstood the complaint, the problem would appear to be that the title company is alleged to be in violation of a long standing law defining settlement activities/conveyance of title to property as a practice of law. This has been the law in Massachusetts since l935 apparently. Massachusetts would seem to disagree with you in that which is required to best protect the homeowner.
Ultimately, the trier of fact will determine whether or not these allegations are true. This is the stuff of which litigation is made.
