REBA's suit in part may protect the MA title abstractor's turf. Not a lawyer, no legal opinion, just passing on a conversation I had with someone at the bottom of the hill like me.
The key in this issue: The title abstract, examination, and issuance of a title insurance policy based on the abstract should be done by an attorney admitted to practice law in MA. Only a MA attorney (with someone PROPERLY performing an abstract) should give an opinion as to title, not a California or Florida attorney. This is section is similar to the CT class action lawsuit. I doubt an MA attorney would agree to give a legal opinion on the quality of title based on an on-line search performed by someone in India or even Wisconsin; for example, Middlesex County comes to my mind. In the long run, this may turn out to benefit professional abstractors in the same way it will benefit professional real estate paralegals.
