We have had this problem with pending suits being indexed under "unknown heirs of" only for the last few years. Our current clerk feels that he does not need to index in any manner other than the way the case is stylized on the complaint. He feels that as the decedent is not a party to the action, it is not his job to index under their name. Generally these are foreclosures filed where the plaintiff is aware that the owner is deceased, but no action has been filed in probate court so there are no known heirs or an executor that we have knowledge of to check in the index. As the clerk indexes strictly by the caption in these cases, which of course can vary, just inputting unknown heirs does not generate an alphabetical list.
