My brother is having trouble collecting on a mechanics lien. The lien was against the developer for work he did on a new house. He had an attorney file the lien, so we can assume it was done correctly. It was filed on the property in the recorders office about a week before the closing. Come to find out, my brother's lien wasn't reported on the title policy. The new owners, the owner's attorney and the mortgage company didn't know about the lien until I told them about it. The developer is refusing to pay. I spoke to the manager of the title company. She said they have the money to pay off the lien, but can't do it until the developer gives the ok. Any advice.
