I haven't looked up the law in this area, but I'm sure there is something actionable against anyone who is making unfounded disparaging remarks against your business. Definitely send a direct letter to the people you know who are making the disparaging remarks (don't cc anyone lest you be accused of libel).
If things ever reach the point that you have to file a lawsuit, you will need the papertrail to back you up to show the judge that you made every effort to curtail the behavior before resorting to the courts. It also prevents the other side from making the "we had no idea that we were doing anything wrong" or "this is the first we've heard of it" arguments in court.
I wouldn't bother with the flyer since, although creative, it might cause more harm than good and just confuse the issue at a later date if things get worse.
