Just a few remarks regarding the concerns voiced here regarding opposition from the various Bar Associations.
Speaking strictly for Pennsylvania, I don't think there's much to worry about. It seems like the real estate attorneys in this state like to be able to pass the liability on. I've been told that it's because attorney malpractice premiums are through the roof. The pocketbook can be a powerful motivator.
As to the issue of "giving legal advice", our boilerplate disclaimer states that our search reports are "for information only". Anyone in this business should seriously consider including a similar disclaimer. An ounce of prevention is worth a pound of cure.
